A non-renewal lease letter tells a tenant you will not extend their lease past its end date. It is how a landlord stops a fixed-term lease from auto-renewing or ends a periodic tenancy. To be valid it names the tenant and property, states the date the tenancy ends, and gives the notice your state and lease require, usually 30 or 60 days.

Send it late or leave out the end date and the lease can roll into a new term you did not intend. This guide explains when you need to send one, how much notice to give, and a free template to copy.

When you need to send a non-renewal letter

You send a non-renewal letter whenever you want the tenancy to end and the lease will not stop on its own. That covers three cases.

  • Auto-renewing leases. Many fixed-term leases roll into a month-to-month or a fresh term unless either party gives notice. The letter stops the renewal.
  • Leases that require end-of-term notice. Some leases require written notice from the landlord even when the term simply ends.
  • Periodic tenancies you want to close, where a non-renewal reads as the notice to end the arrangement.

You do not need a reason to decline renewal in most states, but your reason cannot be retaliatory or discriminatory under the Fair Housing Act. Never tie a non-renewal to a protected characteristic or to a tenant exercising a legal right.

How much notice to give

Notice length is set by your lease first, then your state minimum, whichever is longer. Thirty days is the common floor, with more required in many places for longer tenancies.

Standard notice

Thirty days written notice before the lease end date is the typical requirement. Send it earlier when your lease specifies a longer window, such as 60 days.

Longer notice for established tenants

States including California, Washington, and Oregon require 60 days once a tenant has lived in the unit a year or more, and some jurisdictions require 90 days. Confirm the current rule in your state statute before you send.

Count from receipt

The notice clock starts when the tenant receives the letter, not when you write it. Build in mailing time so the full period lands before the lease end date.

How to send it and protect yourself

Serve the notice the way your lease requires and keep proof, because a non-renewal a tenant claims never to have received can be challenged.

  • Match the delivery method named in the lease before anything else.
  • Use certified mail with return receipt or hand delivery with a witness so the date served is provable.
  • Keep the signed letter and receipt in your records against the property.
  • Avoid any retaliatory or discriminatory timing, and document your legitimate business reason even where none is legally required.
